1. Introduction

Welcome to Frame64 (hereinafter, "the App"), a service provided by eotec robotic s.l. (hereinafter, "we" or "the Company"). By accessing or using the App, you agree to be bound by these Terms of Service (hereinafter, "Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of the Service

Frame64 is a mobile application that allows users to capture, create, and share photos to connected digital photo frames (Pixie devices). The service includes social features such as friend connections, photo sharing, and device management.

3. Account Registration

To use the App, you must create an account by providing a valid email address and a username. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized use of your account.

You must be at least 16 years of age to create an account and use the App.

4. User Content

You retain ownership of any photos, drawings, and other content you create and share through the App ("User Content"). By uploading User Content, you grant us a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of providing the service.

You agree not to upload content that:

• Is illegal, harmful, or violates the rights of others.
• Contains malware or malicious code.
• Infringes any intellectual property rights.
• Is obscene, defamatory, or threatening.

We reserve the right to remove any User Content that violates these Terms without prior notice.

5. Acceptable Use

When using the App, you agree not to:

• Use the service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to any part of the service or its related systems.
• Interfere with or disrupt the service or servers connected to it.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Use automated means (bots, scrapers, etc.) to access the service without our prior written consent.

6. Intellectual Property

The App, including its design, code, logos, and trademarks, is the exclusive property of eotec robotic s.l. and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works based on the App without our prior written consent.

7. Device Connectivity

The App connects to Frame64 digital photo frames via Bluetooth and internet protocols. We are not responsible for connectivity issues arising from your network configuration, device compatibility, or third-party services. Device firmware updates may be required for optimal performance.

8. Service Availability

We strive to maintain the App available at all times, but we do not guarantee uninterrupted or error-free operation. We may temporarily suspend the service for maintenance, updates, or other operational reasons without prior notice.

9. Limitation of Liability

To the maximum extent permitted by applicable law, eotec robotic s.l. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. Our total liability shall not exceed the amount you have paid us in the twelve months preceding the claim.

10. Account Termination

You may delete your account at any time through the App settings. We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your right to use the App ceases immediately, and we may delete your data in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of any significant changes through the App or by email. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Spain.
